Although pregnancy isn’t exactly an unusual condition, it does raise some complex issues in the workplace — especially when laws overlap. The Pregnancy Discrimination Act provides protection against disparate treatment based on pregnancy, childbirth, or related medical conditions. And, although pregnancy isn’t considered a disability under the Rehabilitation Act, some conditions related to pregnancy can be disabilities and therefore qualify for reasonable accommodation. Further, pregnancy and childbirth create FMLA rights, which can be tricky to administer. Finally, because COVID-19 can create serious risks for pregnant women, agencies must navigate how to address those risks without creating liability.
