In June, the U.S. Supreme Court issued a historic decision finding that an adverse employment action based on the gender identity or sexual orientation of an employee is unlawful sex discrimination under Title VII. The decision, which addressed three termination cases and a split in the circuits, was consistent with the EEOC’s earlier decisions in this area, but the majority opinion discussed some potential future issues that federal practitioners will need to understand and anticipate.
